VINDICATED: Torino’s bouncer found not guilty on all charges… [UPDATED]
UPDATE: According to court documents filed in Barnstable District Court, on February 7th, 2018 a jury returned a verdict of “not guilty” on all charges against Brandon W. McAndrew, a bouncer for the Torino nightclub.
On May 22, 2017, the Barnstable police brought the serious charges of “Strangulation/Suffocation” and Assault & Battery after an officer found a bar patron unconscious and unresponsive in the middle of the the roadway…

BARNSTABLE – Brandon W. McAndrew, a bouncer for the Torino nightclub, was arraigned this morning in district court on the charges of Assault & Battery and Strangulation/Suffocation.
Police say they observed McAndrew choking a 39-year-old West Yarmouth man. The victim had been a patron inside the nightclub.
The following are actual excerpts from a report prepared by Barnstable Police Patrolman Nolan O’Melia:
“Upon my arrival I immediately observed multiple Torino bouncers, identified from previous encounters as well as by their shirts stating “Security” on top of a male subject, later identified as [a 39-year-old West Yarmouth man], down in the middle of the roadway.”
“I was approached by [Mr. Broadley], head of security for the evening, who stated the [39-year-old West Yarmouth man] was causing a disturbance and was swinging at bouncers.”
“I identified myself to the bouncers and observed Brandon McAndrew on the left hand side of the [victim] in what appeared to be a rear choke hold and [Mr. McPherson] holding [the victim] down on his left side.”
“I advised McPherson to back away and I attempted to speak with [the victim], advising him I was the police and to remain calm. I received no response from [the victim] and observed his body to be limp at this time. Hyannis FD was requested at this time.” [Please see following HN video and audio]
“I immediately rolled [the victim] onto his back and observed him to be unconscious and unresponsive with agonal respirations. [The victim] was unresponsive to painful stimuli and was cyanotic.” [Cyanosis is defined as the bluish or purplish discolouration of the skin or mucous membranes due to the tissues near the skin surface having low oxygen saturation.]
“Officer Souve arrived on scene at this time and provided me with a BVM as I began to ventilate [the victim]. I ventilated [the victim] for approx. 3 minutes until his respirations increased and became responsive to painful stimuli. [The victim] was lethargic and presented with an altered mental status at this time.”
“I spoke with McAndrew [the Torino bouncer] who provided me with the following statement: This evening he was working as a bouncer at Torino. McAndrew was responsible for the rear entry gate but observed his co-workers in an altercation with a male subject, [the victim]. [The victim] was attempting to hit employees as he was being asked to leave the property. [It] escalated into the street at which time [the victim] ended up on the ground with Broadley in the middle of the travel lane. Additional employees jumped in to restrain [the victim] including McPherson and Moy. [The victim] continued to fight and McAndrew’s stated he “did what he had to do” to get him to stop. McAndrew elaborated that he knew if he choke out [the victim] that would get him to stop fighting. McAndrew placed [the victim] into a choke hold for no more than 10 seconds at which time I arrived on scene.”
“I then spoke to the victim [] in the rear of the Hyannis FD ambulance. [The victim] was conscious and alert at this time and no longer in need of medical attention. [The victim] stated [he was] inside the establishment, McPherson singled him out and told him he needed to leave after harassing a female. [The victim] did not know what McPherson was speaking of and stated a fight occurred. [The victim] remembers ending up in the roadway with multiple bouncers and stated 4 or 5 jumped on top of him. [The victim] was able to see what he believed to be his [friend’s] pant leg from the ground and attempting to get them to stop. [The victim] stated he was yelling to his friends for help at which time he felt pressure on his adams apple (neck) and does not know why they stopped at that point. [The victim] did admit to drinking this evening and stated [he] was confrontational with McPherson, calling him a racial slur.”
“While speaking with [the victim], I observed multiple small lacerations and bruising, some of which was treated by Hyannis FD. I also observed [the victim] to have redness to his neck are from being choked.”
“At this time, BCI was requested to my location for photographs. I returned to speak with McAndrew at this time and advised him he was under arrest…”
“[The victim] refused transport to CCH via Hyannis FD…”
