FOUND GUILTY OF RAPE: 28-year-old Harwich male gets 5 to 6 years for having sex with unconscious victim…
In a press statement, Cape & Islands District Attorney Michael O’Keefe announced that yesterday – December 3, 2018 – a Barnstable County jury found David J. Condon (DOB 7-19-90) guilty of rape and misleading a police investigation.
Judge Robert C. Rufo sentenced Condon to 5 to 6 years in state prison on the rape charge and three years probation from and after on the charge of misleading a police investigation.
The charges stem from an incident that occurred at a residence in Harwich on January 24, 2017.
The victim, defendant, and a third party were socializing and consuming alcohol. The victim lost consciousness and awoke to the defendant having sex with her, to which she never consented.
During an interview with the Harwich Police, the defendant provided investigators with a false address.
The case was investigated by the Harwich Police Department. The case was prosecuted by Assistant District Attorney Michael Patterson.
District Attorney Michael O’Keefe said, “I want to commend the courage of the victim for her testimony and Assistant District Attorney Patterson for his work on the case.”
