Man Head Butts Restaurant Employee and Flees, Police Seize $1800

DENNISPORT- At approximately 2:30pm on Monday afternoon April 23, 2007 Dennis Police responded to a 911 call from BZ’s Restaurant, located at 682 Route 134, concerning an altercation which had just taken place.

  

Upon arrival officers learned that a male subject had been found in the walk-in cooler in the kitchen area of the restaurant by an employee and after being confronted by the employee the subject assaulted him by “head butting” the employee in the face.  Another employee was also assaulted by the subject when he threw a quart sized metal container at him. 

  

Following the assaults the subject left the restaurant and was seen riding a bicycle south bound across route 28.  The subject was located a short time later, hiding at the rear of a nearby park on Hall St. by Patrolman Damon Reinold.  Upon being discovered the individual rode off on his bicycle through neighboring yards with Patrolman Reinold in pursuit.  The subject was finally apprehended about a ¼ mile away, by Patrolman Reinold, after he abandoned his bicycle and attempted to outrun the officer.

  

The subject is identified as Luis F. Martinez, 27 years of age, 11 Treasure Ln. Yarmouth.  Mr. Martinez is being charged with Breaking and Entering in the Daytime, Assault with a Dangerous Weapon, Assault and Battery, and Resisting Arrest.

  

At the time of the arrest Mr. Martinez was in possession of more than $1,800 in US Currency which was confiscated by police after a certified drug detection dog (from the Barnstable Sheriff’s Department, Deputy Sheriff Charles Young and K-9 Morgan) indicated the presence of drug residue on the money.  Dennis Police were also assisted by Harwich Police in the search and apprehension of the suspect.

  

One restaurant employee sustained facial injuries as a result of the assault but refused transport.  The victim stated that he would seek his own medical treatment.

  

Mr. Martinez is being held for his appearance in Orleans District Court on Tuesday morning April 24, 2007.
