Fight at Seafood Restaurant Results in Felony Charges

SOUTH YARMOUTH - Thursday, May 3, 2007 at 9:48 PM the Yarmouth Police Department responded to Kevin’s Seafood restaurant on Route 28 regarding a fight in the parking lot involving a group of people. 

Upon arrival Yarmouth Officers Raymond Scichilone, David Dickey, Bradley Donahue, and Patrol Sergeant Walter Warren, found a group of people in the parking lot and one person unconscious on the ground bleeding from a head wound. 

The on-scene investigation revealed that two men had begun arguing inside the restaurant and then went outside.  An employee of the establishment intervened and tried to stop the fight.  Despite his efforts—the suspect struck the other man causing him to fall to the concrete—strike his head—and become unconscious. Members of the Yarmouth Fire Department assisted the injured man and subsequently transported him to Cape Cod Hospital suffering from non-life threatening injuries.   

Crime Scene Investigator John Szucks of the Barnstable County Sheriff’s Office arrived and photographed the scene and the victim’s injuries. The assailant was placed under arrest and transported to Yarmouth Police Headquarters. 

He was held overnight and transported to the Barnstable District Court this morning. Arrested was Kenneth S. Dauphinais, Age 46 of 894 Route 28, South Yarmouth, MA. He faces charges of Felony Assault and Battery Causing Serious Bodily , Assault and Battery by Means of a Dangerous Weapon, and Felony Outstanding Warrant for Larceny
