YARMOUTHPORT - On Tuesday, July 24, 2007 at 10:07 PM—the Yarmouth Police and Fire Departments responded to a motor vehicle crash into the woods at the intersection of Weir Road and Starbuck Lane in Yarmouthport. This resulted in an arrest for a 3rd Offense as a drunk driver for a Harwich man.

Yarmouth Police Patrol Officers David S. Dickey and Cheryl Nugent Gomsey responded to the scene and located the operator standing outside his crashed vehicle refusing any medical treatment.

While speaking with the operator regarding the crash—Patrol Officer Dickey was told that the crash occurred because his slippers got caught between the gas and brake pedal causing the operator to lose control.

During the on-scene interview—Patrol Officer Dickey detected a strong odor of alcoholic beverages on the operator’s breath and signs of intoxication.  Patrol Officer Dickey administered a series of standardized field sobriety tests and subsequently placed the operator under arrest for drunken driving. The suspect was transported to Yarmouth Police Headquarters and scheduled for arraignment in the Barnstable District Court today.

Arrested was  John E. Giannelli—Age 42 of 615 Main Street, Harwich, MA. He is Charged with Third Offense Felony OUI Liquor and Failure to Stay Within Marked Travel Lanes.

This media release was prepared by Yarmouth Police Department Lieutenant Steven G. Xiarhos—Patrol Force Commander
