Yarmouth Police Arrest Man for Threatening Another with a Loaded Pistol
On Sunday June 14, 2015 at approximately 11:54PM Yarmouth Police Department Patrol Officers Justin A Haire, Alexander J. Xiarhos, Philip E Magnuson, Diana R Wells, Matthew Sheehan, Christopher Eccleston, Erica Wenberg, and Patrol Sergeant Gerard W Britt were dispatched by Yarmouth Police Department Dispatchers Sean Ryan and Kerrie Pentland to the area of Melville Road and North Main Street in South Yarmouth regarding a report that a man had just pointed a loaded gun at someone and a disturbance and fight with a group of people was in progress.
Within minutes, Patrol Officers arrived at the scene and encountered a vehicle at the entrance to the nearby well field with four individuals standing outside. Officers secured the individuals and subsequently located a loaded Smith and Wesson 40 caliber 1911 semi-automatic pistol on the nearby pavement.
The calling party was one of the four individuals detained at the scene and he stated he was visiting someone in the area and a male subject came from a driveway and accused him of breaking into his roommate’s vehicle. A verbal argument ensued between the two of them and he walked away from him towards North Main Street and the man continued to follow him from a distance.
A short time later the man with the gun returned slowly as a passenger in a vehicle and pulled up alongside the victim. Heated words were exchanged between him and the occupants of the vehicle. Police Officers arrived at the scene a short time later and all subjects were transported back to Yarmouth Police Department Headquarters for interviewing by Yarmouth Police Department Detective Scott Lundegren.
After interviewing each witness Beniah K. Cummins was placed under arrest. His weapon has been confiscated and his License to Carry a Firearm suspended.
Yarmouth Police Officers did find several vehicles in the area had been broken in to. The victim in this incident denied any involvement and the investigation is continuing as to who is responsible.
Cummings [was] arraigned on the Barnstable District Court today.
