Yesterday afternoon, Patrolman Joseph Green responded to the Cape Cod Hospital emergency room for a report of a man assaulting nurses, according to a Barnstable Police Department arrest report.
Upon arrival, hospital security informed Patrolman Green the man had punched and kicked a nurse while he was being treated.
Patrolman Green spoke with the nurse, who explained the assault occurred when the suspect was being given an IV.
The nurse was having difficulty locating a vein in the suspect’s arm and explained that it becomes increasingly difficult to perform an IV if someone has received multiple needles in the past.
The suspect believed the nurse was insinuating intravenous drug use and began screaming and kicking, striking the nurse in the legs.
The nurse attempted to push the suspect back and restrain him in an effort to stop the attack.
According to Patrolman Green’s report, the suspect managed to free one of his arms, punching the nurse once in the throat and once in the face…
… that’s when the nurse called for security and police.
James W. Scanlon, age 56, of Kelley Road in Hyannis, was arrested and charged with A&B with a Dangerous Weapon (Shod Foot) for allegedly kicking the nurse, along with Assault & Battery with his fist.
The possible penalty for the above dangerous weapon felony charge ranges from as many as 2.5 years in the house of correction or up to 10 years in a state prison.
According to court records, Scanlon was held in custody after a plea of “not guilty” was entered on his behalf during this morning’s arraignment.
HN NOTE: All suspects are presumed innocent until proven guilty in a court of law.
