YARMOUTH POLICE ARREST MAN FOR DRUNKEN DRIVING WITH LOADED HANDGUN
On Tuesday March 6, 2018 at approximately 12:27AM, the Yarmouth Police Department Dispatch Center received a report of a dark pickup truck driving erratically westbound on Route 28 in South Yarmouth near the Bass River Bridge. The caller reported the vehicle crossed the centerline and almost struck the reporting party head on.
Yarmouth Police Department Patrol Officer Jeffrey Rivett responded to the area and located a black Dodge Ram pickup truck bearing MA Registration 3XT739 operating on Route 28.
Patrol Officer Rivett observed the vehicle cross the centerline of Route 28 two times and both times the vehicle crossed approximately half the vehicle width into the eastbound lane.
When the vehicle crossed back into the westbound lane, it almost contacted the curb outside the white fog line on the right side.
Patrol Officer Rivett stopped the vehicle in the TD Bank parking lot located at 1095 Route 28 South Yarmouth. Yarmouth Police Department Patrol Officer Alexander Xiarhos arrived to provide backup.
The operator was encountered and identified.
The operator had the odor of alcoholic beverage coming on his breath and his speech was slurred and thick tongued and had difficulty understanding the Police Officer.
The operator reported that he had a firearm in the vehicle between the center counsel and the driver’s seat.
The operator was ordered out of the vehicle and the firearm was located and rendered safe.
Patrol Officer Rivett administered the following Standardized Field Sobriety Tests in order to ascertain the operator’s level of impairment.

The operator failed the tests — was placed under arrest — and transported to Yarmouth Police Department Headquarters.
The firearm located in the vehicle was identified as a Glock 43 9mm firearm, which had a 6 round magazine in the magazine well and a round in the chamber.
A second 6 round 9mm Glock fully loaded magazine, a 15 round 9mm Glock fully loaded magazine, and a 5 round .38 special HKS fully loaded revolver speed loader were also located inside the vehicle and seized and placed in evidence.
At the completion of OUI booking, the suspect was placed in secure cell and subsequently released by the Bail Commissioner on personal recognizance after paying the $40.00 fee.
The vehicle that the suspect was operating was towed by Mid Cape Collision and secured at their facility.
The Yarmouth Police Department notified the Plymouth Police Department, which is the issuing agency for the LTC, and the suspect’s License to Carry Firearms was suspended immediately by the Chief of Police.
The suspect is scheduled for arraignment today in the Barnstable District Court.
