BARNSTABLE – According to documents and information obtained this afternoon in Barnstable District Court, Colin T. Kelley, a long serving detective and member of the Barnstable Police Department was charged with Operating Under the Influence of Liquor for an incident that allegedly occurred over the weekend – in the early morning hours of Saturday, December 18, 2021. An arraignment hearing was scheduled today in the criminal main session in Barnstable District Court, in front of Judge Welch. An official arrest complaint was issued. A statement of facts was filed. An appearance was also filed today by Paul J. Anthony, Esq., added as the private counsel for the defendant, Colin T. Kelley. The case was scheduled for a “Valor Assessment Review” to determine where the actual arraignment would be held, whether it be in Barnstable District Court or another separate court somewhere else in the Commonwealth. The next hearing date on this matter is scheduled for January 19, 2022, when either an actual arraignment shall occur or else it will be transferred to another location.
HN began receiving several tips and allegations about the incident earlier this morning. One tipster mentioned the incident may have begun at an earlier Christmas party where other members of the Barnstable Police Department were said to be in attendance. Another tipster related that the incident possibly took place in the early morning hours of Saturday – December 18th, 2021 – and that an on-duty Barnstable Patrol Officer allegedly called in a truck operating “all over” the roadway. The truck was alleged to have eventually been stopped in front of the entrance to the Barnstable Police Department on Phinney’s Lane, and it was also alleged that the truck had rolled into something during the stop… and that the operator was Detective Colin Kelley. Kelley was alleged to have been intoxicated according to this one particular source. Kelley was reportedly placed in a Hyannis FD ambulance and transported to Cape Cod Hospital. He was reportedly not arrested at the scene.
One source alleges that another Barnstable Police Detective may have tried to “cover it up,” meaning cover up the entire incident, and that someone of higher rank was “not having it,” eventually charging Detective Kelley with OUI.
HN reached out to the Barnstable Police Department earlier today in an effort to officially confirm or deny the tipster’s allegations… and HN has yet to hear back from anyone from the Barnstable Police Department’s administration.
While waiting for a return call from the Barnstable Police Department’s administration, another member of the Barnstable Police Department confirmed the incident confidentially, but was not able to go into further detail.
The above HN photos were taken at the entrance of Barnstable Police Headquarters at the time the incident was alleged to have occurred. It shows a pickup truck that had just rolled into a utility pole. It also shows on-duty police officers and members of the Hyannis Fire Department on scene. Officials on scene were attending to someone inside the ambulance.
Another source, and active member of the Barnstable Police Department, later reviewed the above photos and firmly believes the truck against the utility pole belongs to Detective Kelly… and that a second pickup truck parked at the scene belongs to another BPD detective. The morning of the incident, the pickup truck against the pole was quickly removed from the scene and driven away toward the north on Route 132 by a person in civilian clothes, later alleged to be an off-duty Barnstable Police Detective. Prior to it being driven away, an on-duty Barnstable Police sergeant was able to grab a camera from his cruiser and photograph the pickup truck before it was removed from the scene. Again, the Barnstable Police Department has not yet responded to HN’s initial phone call. The above allegations and non-official confirmations from four individuals, two of whom are active members of the department, have not yet been officially confirmed or denied by the department’s administration.
Today in Barnstable District Court, court officials were unable to release the police report because of the pending “Valor Assessment Review” and pending arraignment.
Detective Colin Kelly is scheduled to be back in court on January 19, 2022, according to an official working inside the Barnstable District Court clerk’s office.
