COPS: YARMOUTHPORT HEROIN TRAFFICKER HELD ON $20,000

On February 24, 2019 a Knock and Announce search warrant was obtained from First District Court of Barnstable, authorizing the search of MA Commercial Registration R88351, a 2007 Dodge Ram.
The search warrant authorized officers to search for Heroin, a Class A controlled substance and evidence related to the distribution of Heroin. The search warrant also authorized the search of Frank Berry and any and all present inside of the vehicle. The search warrant was obtained based on probable cause developed during the investigation into the distribution of Heroin by Frank Berry.
On February 26, 2019, at approximately 8AM, Yarmouth Police Department Detectives and Patrol Officers executed the search warrant on MA Commercial Reg R88351, a 2007 Dodge Ram, as Berry drove through the neighborhood of Berry’s residence on Whistler Lane in Yarmouthport.
Officers conducted a search of the vehicle. During the search, 55 plastic baggies containing .4 grams each (gross approximate weight of 22 grams), of an off-white powder (Heroin) were recovered along with a knotted plastic baggie containing 12.8 grams of an off-white powder (Heroin), a digital scale, a black Samsung Galaxy S7 cell phone, and multiple unused plastic (1/2 gram size) baggies.
Found on Berry’s person was a plastic baggie containing 1.4 grams an off-white powder (Heroin), which was also seized. The off-white powder was later tested using a Nark II style test pouch and the substance tested positive for heroin.
Subsequent to the execution of the search warrant, Frank Berry was transported back to Yarmouth Police Department Headquarters.
At approximately 9:30 AM, Detectives executed another search warrant at his residence on Whistler Lane, Yarmouthport, Berry’s parents answered the door and were presented with the search warrant for the residence.
Detectives were directed us to Berry’s bedroom located on the second floor of the home. During the search of Berry’s bedroom investigators located 10 Suboxone strips hidden within various video game instruction manuals. Located inside of a bedroom drawer was a small baggie containing .3 grams of an unknown white powder, four baggies (.8 grams, .7 grams, 1.1 grams, & .5 grams) containing an off-white powder (heroin), and $1,580.00 cash.
On the completion of the investigation, Berry’s 2007 Dodge Ram was seized for forfeiture based on his using the vehicle to facilitate his drug distribution business.
Berry, a convicted felon with 23 prior charges in Massachusetts, has been arraigned in the Barnstable District Court and is currently being held pending trial.
