[MEDIA STATEMENT] Cape and Islands District Attorney Michael D. O’Keefe announced today that Michael Mahoney (DOB: 9-19-84) of Mashpee was arraigned in the Barnstable Superior Court after having been indicted on charges of Negligent Motor Vehicle Homicide and Leaving the Scene of a Death in connection with the death of Michael Leis (DOB 2-18-40) of Framingham. The indictments stem from an incident on September 10, 2021. Falmouth Police responded to the area of 197 Grand Ave. after a report of a pedestrian being struck by a fleeing motor vehicle. The victim was taken to Falmouth Hospital where he was pronounced deceased. On December 10, 2021, following a three-month investigation, members of a Barnstable County Grand Jury returned indictments against the defendant. The matter was investigated by the Falmouth Police Department with assistance offered by divisions of the Massachusetts State Police and is being prosecuted by Assistant District Attorney Michael K. Giardino. The defendant was arraigned today in front of the Honorable Mark Gildea. A pretrial conference has been scheduled for January 27, 2022.

On 09/10/21, at approximately 11:35 PM, officers responded to a car vs. pedestrian crash in the area of 201 Grand Ave. in Falmouth Heights. The vehicle involved fled the scene of the crash. The pedestrian who was struck was an 81 year old male who sustained fatal injuries.
The victim was walking on the sidewalk with three other adults. The other pedestrians were not injured. The vehicle was travelling easterly at a high rate of speed when it travelled onto the sidewalk and struck the victim from behind. The operator did not stop and the vehicle continued easterly on Grand Ave, and onto Menauhant Rd.
The suspect vehicle is believed to be a red sedan that rides low to the ground. The vehicle has heavy windshield damage and likely other serious front end damage.
The Falmouth Police Department and the Barnstable County Sheriff’s Office are investigating. The investigation is extremely active and we are studying all of the evidence, including video footage from several area surveillance cameras.
