SOURCE: Man charged with possession of gun, plus possession with intent to distribute class A & B substances… showed up to court with cocaine on him… then walked out same day free on bail…

BARNSTABLE – According to an inside source, Flavio Gambarotto-Santa was arrested during a search warrant service this past Thursday by Barnstable Police detectives in Hyannis (In the Sea Street area to be more exact…). He was subsequently arrested for possession with intent to distribute both class A (typically heroin and other opiates) and class B substances.
Police also found him in possession of an unlicensed gun and charged him with that as well…
Gambarotto-Santa was transported back to BPD Headquarters for booking and was later set free on $2500 bail.
The following day, Friday, Gambarotto-Santa arrived at court for his arraignment. He was taken into custody again while he awaited a Portuguese translator.
While searching Gambarotto-Santa, a court officer reportedly found cocaine on him prior to placing him in a holding cell. Court officers notified detectives and told them about Gambarotto-Santa showing up for court with cocaine on him. Gambarotto-Santa now faces the additional charge of a second count of possession of a class B substance.
Also, according to court documents, Gambarotto-Santa has another case from back in July where he is accused of Assault and Battery on a Barnstable Police Officer… he is scheduled for a pretrial hearing on that charge on January 26, 2015.
But here’s the real story:
Even though Gambarotto-Santa is facing all those charges; A&B on a P.O., possession of a gun, possession with intent to distribute dangerous drugs, class’s A & B… and then showing up to court with cocaine… Gambarotto-Santa waltzed out of Barnstable District Court this past Friday after being set free by Judge W. James O’Neill on just $2500 cash bail.
Gambarotto-Santa was spotted on the streets of Hyannis later that very same evening.
It is uncertain whether Gambarotto-Santa still has access to guns, but he recently posted this facebook picture of himself holding handguns. Gambarotto-Santa does not have a license for firearms (although he does seem to be quite fond of them…).
As for Judge W. James O’Neill, I’m sure he had very good reasons why he released this suspect back into our community on such low bail. I’m somewhat uncertain, however, whether I’ll ever fully understand those reasons.
Hopefully Gambarotto-Santa’s alleged one-man crime spree is over until his next appearance in court on December 1, 2014, which is marked up for his pretrial hearing on the gun and drug charges. (As mentioned above, the pretrial hearing on the pending A&B on a Police Officer charge is scheduled for much later, on January 26, 2015.)
Hyannis News will provide updates to this story as they become available.
