WEAPONS SEIZED FROM MONEY LAUNDERING SUSPECT: Loaded .45 reportedly found out ready to rock ‘n’ roll on living room end table near infant child…
BARNSTABLE – According to a report filed in district court by Barnstable Police Detective Brian Guiney, on September 5, 2018, at about 5:30 am, members of the FBI, IRS, Massachusetts State Police, Bristol County Sheriffs Office, and Barnstable Police Department met at BPD Headquarters to discuss the matter of a Federal Arrest and Search Warrant for Mark Scott, age 50, of 133 Sunset Lane in Barnstable, Ma., on the charge of Money Laundering.
About an hour after their little chat at BPD Headquarters, an FBI agent and state trooper conducting surveillance, spotted Mark Scott driving his 2018 BMW on Millway Ave toward his residence on Sunset Lane. A traffic stop was conducted shortly thereafter and Scott was taken into custody.
While searching the BMW’s front seat center console, officers found a loaded .40 caliber Heckler and Koch semiautomatic handgun with its “high capacity” magazine containing 13 rounds. It was then that Detective Guiney identified himself and informed the suspect that the Barnstable Police Department was revoking his gun license.
While the suspect was being transported to the BPD for booking on the Federal Warrant, Detective Guiney and Federal Agents continued on to Scott’s waterfront residence, at 133 Sunset Lane (see following Google image).
Upon opening her front door after hearing a knock, Lidia Kolesnikova, the suspect’s wife, came face-to-face with IRS & FBI Agents, along with a couple of Barnstable’s Finest.
An FBI Special Agent explained to Kolesnikova that he had a Federal Warrant to search the residence. After being shown the warrant, Kolesnikova reportedly invited the law enforcement officials into the residence.
An infant child was observed on the floor in the middle of the living room. Nearby on an end table, Detective Guiney reports he observed a loaded unsecured (no locking device) .45 caliber HK semiautomatic handgun. Detective Guiney asked Kolesnikova what was up with the loaded unsecured weapon on the end table. According to the report, “Kolesnikova stated that it wasn’t loaded. [Detective Guiney] stated to Kolesnikova that it was loaded with ten (10) rounds but not one in the chamber and she stated “that’s what I meant.”
Lidia Kolesnikova was then placed under arrest for Wanton or Reckless Behavior Creating Risk or Child Endangerment. Barnstable Police Sergeant Bitinas contacted the Department of Children and Families (DCF), who responded to the scene and took statements. The report continues, “The child was placed in the custody of the Nanny per DCF.”
Detective Guiney continued his search and located the following:
1. an unsecured (no locking device) 9mm Heckler and Koch VP9SK semiautomatic handgun,
2. an unsecured loaded Smith and Wesson 44 Magnum revolver,
3. an unsecured unloaded Remington 12 Gauge Marine Magnum Shotgun,
4. a total of four thirteen round high capacity magazines,
5. and 7 additional magazines, shot gun shells, along with various boxes of handgun ammo.
All firearms, ammunition, and magazines were seized and transported to BPD Headquarters and placed into evidence.
In addition to the Federal Money Laundering rap, Mark Scott was arraigned in Barnstable District Court this past Monday – 11/26/18 – on 4 counts of Improperly Storing Firearms, and 2 felony counts of Possessing Large Capacity Magazines.
Scott is due back in court on January 22, 2019 for his pretrial hearing on the firearm charges.
