HANDGUN W/ HIGH-CAP MAG REPORTED STOLEN FROM MISSISSIPPI WOMAN RECOVERED FROM HYANNIS MAN’S CLOSET
HYANNIS, MASSACHUSETTS – A high-capacity handgun reported stolen Friday evening – 4/12/24 – by a Mississippi woman visiting a downtown restaurant was recovered from a Hyannis man’s closet the next day – Saturday, 4/13/24 – and police are not buying the man’s story.
Curtis McMahon, 33, of Hyannis walked into the Barnstable Police Department Saturday afternoon reporting he found a black fanny pack containing a gun in the East End of Hyannis… and that the handgun was currently located inside a closet in his Hyannis apartment, according to police reports. Officers responded to 34 Yarmouth Road where they met McMahon in the doorway of his residence. McMahon reportedly gave officers consent to enter his apartment and retrieve the firearm, which was found in a Target bag inside McMahon’s closet.
But according to police reports, McMahon’s story did not add up and he was subsequently placed under arrest once the gun was recovered. The firearm was identified as an FMK 91C 9mm pistol, with a 14 round FMK magazine loaded with a round in the chamber. A total of seven 9mm rounds were inside the pistol’s chamber and magazine.
McMahon was transported back to BPD headquarters where he was charged with the following:
– Possession of a Firearm Without an FID Card,
– Possession of Ammunition Without an FID Card,
– Possession of a Large Capacity Feeding Device (Felony),
– Larceny of a Firearm (Felony), and
– Larceny of a Credit Card.
According to a report filed by Barnstable Police Detective Andrew Johnson, “McMahon explained that he knew as soon as he brought the gun into his house he knew this would be happening, referring to his arrest. He explained he saw the report of the stolen firearm on Hyannis News.”
On the evening of Friday – 4/12/24 – Barnstable police officers were dispatched to the Hyannis Package Store for a Mississippi woman reporting her fanny pack stolen from her vehicle in the area of KKaties Burger Bar. The fanny pack contained her credit cards and a handgun. At around 9:45 p.m., Friday evening, the Mississippi woman received a bank alert that someone was attempting to use her credit card inside the package store… and police were eventually able to view video surveillance of a man attempting to use the stolen credit card.
On Saturday evening, Detective Johnson reportedly conducted a “post arrest interview” with McMahon, who was still in custody. Barnstable Police Patrolman Kevin McNamara, the primary investigating patrol officer, was also on hand during the interview. The interview was audio and video recorded. McMahon was reportedly read his Miranda Rights and had signed a waiver to speak with investigators.
The following are excerpts from Detective Johnson’s summary of the interview:
“He explained while driving he observed a homeless black male carrying a black North Face bag. He explained that the bag did not appear to belong to him, so he told him that it was his. He explained the homeless man provided him the bag without incident. McMahon explained this occurred at approximately 9:30 PM in the area of Center St and Main St…”
“McMahon explained that he traveled west up Main St and completed a right turn onto Barnstable Rd near the 19th Hole Bar. He explained that it was around this time he had opened the bag, and realized there was a firearm inside of it. He explained this happened within seconds of obtaining it from the homeless man. I asked him if there was anything else in the bag. McMahon explained that there was an “airtag” inside of the bag, which he explained he disposed of in the Bradford’s Ace Hardware on Main St. He explained he did so in the rear parking lot of the store. I later asked him why he got rid of the “airtag” and he explained, ‘Once I discovered it was a firearm I was about to turn into my house, Oh… they’re gonna be looking for this.’ This statement was contradictory to his previous statement about recognizing it was a firearm as he turned onto Barnstable Rd. He explained he then returned to his home […] and secured the firearm inside. McMahon stated while explaining this, ‘This is where I went wrong.’ […] He explained that during this time he was getting pressured from his girlfriend to come over, so he left the firearm at his residence and traveled to his girlfriend’s home on Great Western Rd in Dennis. He explained he returned to his residence later that night.
McMahon explained that he knew as soon as he brought the gun into his house he knew this would be happening, referring to his arrest. […] McMahon explained that there were no other items (with exception of the airtag) inside the North Face bag, and described it as a fanny pack. He explained that he “dumped” the North Face bag on an unknown road or “vicinity” of his residence. I asked McMahon to describe the homeless man he obtained the North Face bag from as he had told investigators that he has seen this male before as he frequents Main St. He described the homeless man as a ‘middle aged black guy, about 5′ 7”, wearing a white sweatshirt.’ McMahon explained he saw the homeless man pick up the North Face bag off of Main St, on the same side of the road as Bread & Roses and Flashback. He explained that the homeless man must have seen the firearm in the bag, as he handed it off to him and the bag was already open. McMahon explained that he observed the homeless man pick up the bag off of the pavement as he drove by the area of Flashback Restaurant. He then circled the block, taking Barnstable Rd and returned to Center St. He explained that he had been driving his Ford Escape, color purple/silver, which is registered to him.
[…] He denied that he broke into any motor vehicle on Friday evening, and he did not see the homeless man enter any vehicles. Ptl. McNamara asked him if he went anywhere else during the evening, which he replied the only place he went to was his girlfriend’s home. Ptl. McNamara showed McMahon the image he had secured from the Hyannis Package Store. This picture […] showed a white male who had attempted to use the victim’s credit/debit card in the package store, that appeared to be McMahon based on the physical characteristics and face. McMahon explained, ‘I don’t know who that is.’ Within one minute of this evidence being brought to McMahon’s attention he requested a lawyer and the interview concluded shortly after.”
The handgun was reportedly submitted as evidence pending further analysis by the Massachusetts State Police Crime lab. [NO FURTHER INFO AVAILABLE AT THIS TIME… DEVELOPING…]
