OSTERVILLE, Massachusetts – There are new details from early Sunday morning, when an Osterville homeowner was reportedly struck in the head and severely injured.
According to a report filed in Barnstable District Court by Barnstable Police Patrolman Eric Rogorzenski, on May 7, 2023, at around 1:40 a.m., he and other officers were dispatched to a report of a large fight outside of a residence at 2820 Falmouth Road (Rte. 28). Upon arrival, they found the young adult male owner of 2820 Falmouth Road inside a bathroom, suffering serious injuries to his head, which included bleeding, acute pain, and what was described as a “large gash” above his left eye. Using social media applications, witnesses were able to identify and show police the profiles of the four men they say had just attacked the now stricken homeowner.
According to the report, there had been an ongoing party amongst friends and the four alleged attackers showed up and were not welcome. The homeowner reportedly encountered the four adult males outside of his residence and asked them to leave. According to witnesses named in the report, there were verbal unpleasantries exchanged by the four individuals when they were asked to leave. Fists reportedly started flying and the young adult male homeowner was knocked to the ground. According to the police report, one witness told officers, “all four (4) parties then began kicking and stomping on the [homeowner’s] body and head… a small wooden bat was shown in which he identified Baldasaro striking [the homeowner] in the head… Baldasaro then used the bat [to smash] the rear left passenger window of his friend’s vehicle.”
Another witness reportedly told police “he observed a male party who he identified as Baldasaro use a small dark colored bat to break his rear left passenger window.”
Another witness reportedly also told police, “four (4) parties who he later identified as Dos Santos, Fraga, Jordao and Baldasaro arrived at 2820 Falmouth Road attempting to get into the party. As the homeowner told them they are not welcome, a physical fight broke out in the driveway of the residence. [The third witness] stated that the four (4) parties had knocked [the homeowner] to the ground as they began kicking and punching him in the head. [The third witness] identified Baldasaro with a small wooden baseball bat and explained he had struck [the homeowner] in the head and had broken a car window before fleeing the area.”
Additional police officers reportedly responded and were told there was probable cause for the arrest of all four alleged party crashers. A dark colored wooden baseball bat was found on scene, broken in two pieces. A member of the Sheriff’s Crime Scene Investigation Unit photographed the bat and collected it to be processed as evidence.
A Barnstable Police patrolman was dispatched to Cape Cod Hospital where he reportedly collected a statement from the severely injured homeowner. The young adult male homeowner reportedly only remembers attempting to escort several individuals away from his home when he was suddenly hit in the head. The homeowner reportedly stated he does not remember what happened next and found himself on the ground when he finally woke up.
The homeowner’s injuries were reportedly severe, and he was later transported to a Boston medical facility to be treated for serious facial damage, including a fractured orbital bone and “large laceration” on his eyebrow.
Patrolman Rogorzenski’s report continues as follows: “A short time later, Ptl. Murray was conducting surveillance of [] 2820 Falmouth Road where he observed a dark colored pickup truck bearing MA Registration #3FBX88 enter the driveway. Ptl. Murray then identified Jordao, Dos Santos and Fraga inside of the vehicle. Ptl. Murray requested several officers to his location where all three parties were taken into custody without incident…

All three parties were advised of their Miranda Rights in which they acknowledge and refused to speak to officers. While on scene officers observed several cuts located on Fraga’s left hand and knuckles. All cuts appeared to be fresh as they continued to bleed. Fraga had blood stains on the left front pocket of his pants and blood stains on his white long sleeve under shirt. All injuries were documented and clothes seized by BCI for processing. Located on Dos Santos, officers observed a small laceration above his eyebrow. The injury was later documented with BCI. The pickup truck bearing MA registration #3FBX88 was secured by Capeway Towing.”
CLAUDIO JORDAO, LUCAS DOS SANTOS, AND KEVIN FRAGA were all reportedly arrested and charged with A&B WITH A DANGEROUS WEAPON on the evening of the incident.
ANDREW BALDASARO later turned himself in at court after a warrant had been issued, according to Lt. Mark Mellyn of the Barnstable Police Department. BALDASARO is reportedly being charged with A&B WITH A DANGEROUS WEAPON, VANDALISM, and A&B WITH SERIOUS BODILY HARM. [DEVELOPING]
